The Morgan Rose insolvency team frequently acts in cases brought under the Director’s Disqualification Act (CDDA) by the Secretary of State and Revenue and Customs Prosecution Office (RCPO).  Disqualification under the CDDA prohibits the person acting in the management, promotion or formation of a company for up to 15 years.  Cases of self-reporting to the Serious Fraud Office (SFO) where a company discovers fraud or corruption can involve the SFO referring director(s) for CDDA disqualification.  Expert advice from skilled Morgan Rose litigators has helped many clients avoid or minimise the effect of CDDA orders.

We assist clients faced with possible bankruptcy and frequently advise on practical ways to avoid it, including the negotiation of formal agreements with creditors in an IVA.  Our team assists with annulling bankruptcy orders and are regularly instructed by Insolvency Practitioners to obtain orders for Possession and Sale.

Our insolvency team has helped directors whose business is experiencing financial difficulty, often securing time and protection from impending litigation brought by creditors of the Company, by obtaining an Administration Order.  It is often critical to have a moratorium in place to allow the company vital breathing space whilst a decision is reached on how to achieve the best possible outcome for creditors.  Our clients include directors and a broad range of Insolvency Practitioners.

We are frequently instructed on matters relating to the liquidation of companies, advising directors on addressing corporate governance issues.  We often deal with cases involving allegations of transactions at an undervalue, preferences, transactions defrauding creditors, wrongful trading and fraudulent trading by both insolvency practitioners and directors.
