Morgan Rose wins important decision in the Court of Appeal

Morgan Rose successfully represented a client in his appeal against conviction for attempting to convert criminal property contrary to section 327(1) of the Proceeds of Crime Act 2002.  Our client was a scrap yard worker who was approached by undercover officers claiming that they had brought stolen cable to the yard.   Instructing Alex Stein of No5 Chambers, we successfully argued that mere suspicion is not sufficient to support a conviction for the offence and that the prosecution must prove that the defendant knew the property to be criminal property. The decision will have an impact on a large number of cases in which individuals have been convicted or charged under similar circumstances.
